A Child Must Not Be Discriminated Against Based on Their Parents’ Gender

The Queere Vielfalt Association (LSVD+) launched a petition this weekend to reform the parentage law. It is aimed at Federal Justice Minister Stefanie Hubig (SPD) and advocates finally eliminating years of remaining discrimination against rainbow families. The petition has already been signed by more than 7,000 people.

The background: When a woman has a child, her wife must rely on stepchild adoption, while a husband can automatically be recognized as the legal father—even if he is not the biological father. Although same-sex marriage was introduced in the autumn of 2017, lawmakers have not yet abolished this discrimination. This can have grave consequences for the child: if the biological mother dies in an accident, the child becomes legally orphaned, and the grieving widow could have the child taken away by the youth welfare office.
