Brad Little, the Republican governor of Idaho, signed on Tuesday what is the draconianest law against transgender people in the United States to date — on International Trans Day of Visibility. Trans women who use a public women’s restroom, or trans men who use a public men’s restroom, now face up to five years in prison.
The bill HB 752, which had previously been approved by both chambers of the Boise legislature with Republican majorities, specifically prohibits “knowingly and intentionally” entering a public restroom that does not correspond to the sex assigned at birth. A first offense carries one year in jail, and a second conviction carries five years.
“A heartless attack on our own people”
Scharpe Kritik kommt von queeren Organisationen: “Putting someone in jail just for using a toilet is nothing but pure, unfiltered cruelty,” said Delphine Luneau, spokesperson for the Human Rights Campaign. “This is an overt and heartless attack on our own population that threatens to ruin the lives of innocent people without contributing to solving the real problems facing families in Idaho.”
LGBTQ activists warn that it raises the risk of being outed — including forced or false outings. People who do not visually conform to the gender expected for the mandated restroom would be at higher risk of harassment and physical assaults. There have already been cases in other states with bans where, for example, trans men — as required — used a women’s restroom and were subjected to insults. The fear of criminal prosecution or violence could also drive affected individuals to avoid public spaces and private businesses.
Sogenannte “Bathroom Bills” gibt es bereits in der Hälfte der US-Bundesstaaten, meist im konservativen Süden des Landes. Meistens sind jedoch nur Geldstrafen in bestimmten Fällen vorgesehen. In Florida drohen aber bereits jetzt bis zu 60 Tage Haft. Mehrjährige Haftstrafen wie in Idaho gibt es aber bislang nirgendwo.
Manche Polizeiorganisationen wie die Idaho Chiefs of Police Association haben ebenfalls vor dem Gesetz gewarnt. So sei es schwierig, vor Ort das “biologische Geschlecht” einer Person festzustellen — und könnte möglicherweise dazu führen, dass Beamt*innen wegen sexueller Belästigung verklagt werden.

Politikwissenschaftler*innen zufolge wollen die Republikaner mit ihrer transfeindlichen Politik insbesondere evangelikale Christ*innen bei den Zwischenwahlen im November an die Wahlurnen locken. Sie lehnen die Akzeptanz von trans Menschen — und meist auch von Homosexuellen — grundsätzlich ab.
