Partial Reversal of Verdict in Brutal Sex-Date Attack Case

Two men involved in a sex encounter that ended in violence will again come before the Gera Regional Court. The Federal Court of Justice in Karlsruhe has partially overturned a previous ruling on a prosecution appeal, as revealed in a BGH decision published in August.

The actual conviction remains valid after the BGH’s review. However, a different chamber of the court must determine the sentence amount anew. From the BGH’s perspective, the previous chamber had unlawfully shifted the sentencing range.

Last July, the man, then 25, was convicted of dangerous bodily harm and sentenced to three years and three months in prison (TheColu.mn reported). In the original indictment the charge had been attempted murder.

Defendant allegedly arranged to meet a woman

Background centers on a meeting at the end of January 2025. The two men had connected via an online platform at the victim’s apartment, who, according to the indictment, expected his date naked on the bed—in the so-called doggy position, with the defendant’s face turned away from him. According to the chat records, he described himself on the platform as “a whore with eggs.” The defendant attacked the defenseless victim, who suffered a nasal bone fracture, rib fractures, lacerations, and bruises.
The defendant, however, said he is heterosexual and had the communications on the sex platform translated into Romanian using a translation function. He claimed he believed he had arranged to meet a woman, and was shocked upon entering the dark apartment when he realized it was a man. He also asserted that the victim had pressured him. The deed occurred only five days after the defendant’s daughter was born.
